We are an English/French family with three children who have spent their childhood at the farmhouse and always had such a fabulous time, whatever the season. We absolutely adore Provence and Eygalieres in particular because it is such a gorgeous part of the world with so much to do, enjoy and discover.

Now the children have left the nest, we have decided to share our pleasure with our guests.

The farmhouse is a "maison de famille". It has the feel and charm of a true family home to the delight of our guests.

Terms & Conditions (please read prior to booking)

The following conditions, together with the property description will form part of your contract with the Owner. Please read them carefully before you book as they set out our respective rights and obligations and you will be bound by them.


You must provide the following details to masdelaplume@aol.com to validate your booking (failure to do so will be considered as a cancellation by you, the client):


- For the person responsible for the booking: Full name, Address, Landline phone number, Mobile (cell phone) number, Valid email address

- Details of the group with, for each guest: Full name and whether the guest is an adult, child or infant


Please note that this list cannot exceed 10 people (adults, children and infants)


RENTAL AGREEMENT


CONTRACT

The Contract for a short-term holiday rental at “Mas de La Plume” in Eygalieres, France shall be made between the Client (you) and the Owners (we). These references also apply to Owners' and Clients' heirs, executors, administrators, or successors, as the case may be.

A contract will come into existence on the date on which we receive your booking deposit and accept your booking in writing (or, as it might be the case, as soon as you booking is processed by Provence Rentals).

We will acknowledge your booking and issue you with instructions to reach the farmhouse and obtain the keys, once the full payment (rental and damage deposit) is received.

When you make a booking you are confirming that you understand our booking conditions and have accepted them on behalf of yourself and all members of your party.

This contract and any matters arising from it are governed by the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.


CONDITIONS OF HIRE

- The minimum letting period is seven nights or in multiple of.

- Rentals commence at 16.00 pm on the Saturday of arrival and terminate at 10.00 am on the Saturday of departure. Please note that these times are firm due to the time required to prepare the house between clients.

- The number of persons occupying the property must not exceed ten (10) including adults, children and infants for whole or part of the stay. We reserve the right to refuse entry to the entire party if this condition is not observed. Should you over-occupy the property without previous agreement, you will forfeit your damage deposit and occupancy of the farmhouse will be terminated without refund.

- You agree to use the premises as a private holiday residence only and not for any other purposes whatsoever (not for parties, wedding, etc.).

- You do not permit to be done anything, which may be a nuisance or annoyance or cause of damage to any neighbouring property.

- In the event of breakage or need for maintenance, you must inform immediately the house manager for the repair to be organised.

- The property will be clean at the beginning of your rental period and you must leave it clean on your departure.

- You shall not sublet the entire premises or any part of the premises, nor shall they assign this Agreement to anyone else.

- You assure us that any member of your party who violates any of the terms of this Agreement shall be immediately denied occupancy and shall remedy any damages or other expenses caused.


BOOKING PROCEDURE

Booking form: For all bookings (directly or via HomeAway), you must complete and sign the booking form and return it within 7 days to us at masdelaplume@aol.com

You must be over 25 years of age and authorized to make the booking and to accept these Booking Terms & Conditions on behalf of his/her group.

You will be responsible for making all payments due. Any booking obtained under false pretence will be subject to your forfeiture of any deposit and/or rental money, and the party will not be permitted to check in.

Payment of Booking deposit:

Any booking will be secure only once the rental deposit (50% of total rental costs) has been received and you have returned the completed and signed booking form.

If you are booking within 60 days of departure, then full payment (100% of total rental costs) is required immediately.

Payment of Balance of rental fee:

Your final payment is due to reach us no later than 60 days before the start of the rental period.

Non-payment of the balance of the rental on the due date shall be construed as a cancellation of the Contract by the Client.

Payment of Security and Damage Deposit:

As a condition of your rental agreement we shall also ask you to pay for a Security Deposit, 60 days before the start of the rental period.  This is to protect the property for the cost of extra cleaning or any damage or loss caused by wilful or accidental damage by members of your party that may occur during your stay. Failure to pay will be considered as a cancellation by you. The House Manager will reports any costs for any required extra cleaning, loss or damage within the property. The security deposit will be refunded to your account (please provide details of your account) two weeks after departure, minus incurred costs if required.

Payment must be made to us in GBP Sterling by bank transfer (details supplied on the booking form). For card payment, please contact owners.


Security and Damage Deposit

As a condition of your rental agreement we shall also ask you to pay £3000 for a Security Deposit, 60 days before the start of the rental period.  This is to protect the property for the cost of

- Extra end-of-stay-cleaning: due to previous unpleasant experience, please note that a minimum of £500 will be deducted from your damage deposit if property is left in a state that requires extra cleaning and/or tidying, garbage removal, etc.

- Any damage or loss caused by wilful or accidental damage by members of your party that may occur during your stay.

Failure to pay will be considered as a cancellation by you.


Please check and abide the house rules stated below as failure to follow them could lead to the forfeiture of your damage/security deposit.


The House Manager will proceed to an end-of-stay inspection with you and reports any costs for necessary extra cleaning, loss or damage within the property. Failure to attend to the checkout forfeits any rights to dispute the reported list of damages. The security deposit will be refunded to your account (please provide details of your account) two weeks after departure, minus incurred costs if required.


CANCELLATION

We have a no refund cancellation policy, but usually succeed in rescheduling cancelled reservations to the Spring or Autumn or re-booking the cancelled period to another party and refunding the party that cancelled (only up to the level of the replacement rental fee).

Clients are advised to consider Trip Cancellation Insurance with the carrier of their choice at the time of confirmation. We strongly advised to consider recommend that, at the time of booking, you secure adequate travel cancellation insurance which should, in most cases, include cover against loss of deposit or cancellation fees.

Cancellation by Clients:

If you fail to provide information about yourselves or to pay the balance of the holiday price at least 60 days before the rental start date, we will then treat your booking as cancelled by you with no refund.

Cancellation by owners:

We reserve the rights to cancel your rental for any reason, but mostly in case of Force Majeure or for any reason that makes the property unfit for rental. This will lead to a full refund of monies paid by you (minus any credit card or transfer fees).  

Please note that we are not liable for any consequential loss or incidental expenditure resulting from the cancellation.


LIABILITY

We do not accept third party liability in respect of breach of contract, negligence, misrepresentation or otherwise. We shall not be liable to you for any temporary defect or stoppage in the supply of services to the property, nor in respect of any equipment, plant, machinery or appliance in the property, garden or swimming pool. Under no circumstances shall our liability to you exceed the amount you paid to us for the rental period. You assume any risk, take full responsibility and waive any claims of personal injury, death or damage to personal property associated with the property. The swimming pool is conform to French regulations and used entirely by you and your group at your own risk. You hereby release us of any claims demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of any kind with respect to personal injury including death while using the property's pool.


INSURANCE

We have obtained property and liability insurance to cover certain personal injuries occurring as a result of property defects. Our insurance does not cover your possessions or negligence. It is a condition of your contract with us that you and all members of your party have comprehensive travel insurance cover that is adequate for your needs. Your policy of insurance should provide cover for personal injury, death, medical and repatriation costs, together with cover for loss of baggage and valuables, personal liability, cancellation, curtailment, missed departure and legal expenses.


NON-WAIVER

Should either Owners or Client waive their rights to enforce any breach of this Agreement, that waiver shall be considered temporary and not a continuing waiver of any later breach. Although Owners may know when accepting rent that Clients are violating one or more of this Agreement's conditions, Owners in accepting the rent are in no way waiving their rights to enforce the breach. Neither Owners nor Clients shall have waived their rights to enforce any breach unless they agree to a waiver in writing.


WAIVER AND RELEASE FROM LIABILITY

You hereby waive and release, indemnify, hold harmless and forever discharge us and our representatives or employees from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, including claims of our negligence, whether known or unknown, in law or equity, that you ever had or may have arising from or related to the renting of the property and for the duration of the stay at the property. We, and our representatives or employees, are not liable for loss, damage of property, to/of you or your party. You assume any risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with the property including but not limited to man-made hazards associated with the property.


WARRANTIES

We do not warrant and are not responsible for the accuracy of any verbal information given or statements made by any of its employees or agents. Property description: Every effort is made to ensure that the details, description and prices contained in our website are correct. However changes do occur therefore we will advise you at the time of booking, or if after booking as soon as possible of any such changes to the published information.


COMPLAINTS

If you are unhappy with any aspect of the property and/or its facilities while you are on holiday, you must address your complaint immediately to the House Manager who will do her best to rectify the situation during your stay.

It is unreasonable to take no action whilst on holiday, but then to write a letter of complaint upon return. If the problem cannot be resolved locally and you wish to complain, full details must be sent to the Owners in writing to arrive within 30 days of your return. The Owners will do their best to investigate and reply to you within 28 days of receipt of your letter. Failure to take either of these steps will deny the Owner the opportunity to resolve the problem immediately and/or investigate it properly. In consequence, this may affect your rights under this contract.

RIGHT OF ENTRY

The Owners or they representatives shall be allowed the right of entry to the property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.

USE OF PROPERTY AND HOUSE RULES


YOUR SAFETY & PROTECTION

Please be careful when in unfamiliar buildings or surroundings, and get to know the escape route from the house in case of fire.  The property may include hazards and it is imperative that your party take responsibility for their own safety. Please take advantage of the burglar alarm and take every precaution against theft and burglary.

Any valuables left at the property are left at your own risk. We cannot take responsibility for any loss or damage.


CLEANER SERVICE

The housekeeper will come mid-week and will generally tidy and clean the property.

She/he will then come at the end of the week to change bed linen / towels and clean the property.

Please treat her/him fairly and allow access for the cleaning.  Abuse of staff will not be tolerated.

She/he will not wash dishes or clothes and should not have to dispose of rubbish for you.


During your stay, additional cleaning and/or laundry service can be organised at extra cost.


End-of-stay extra cleaning: due to previous unpleasant experience, please note that a minimum of £500 will be deducted from your damage deposit if property is left in a state that requires extra cleaning.


HOUSE MANAGERS

Our house managers are employed to look after our guests whilst they stay at our property.

They are on-call and at your disposal if you require assistance or wish to report any issue.

They are courteous and we expect them to be treated the same way.

Following unpleasant experience, any unnecessary call at unreasonable hour for any non-urgent matter shall be charged at £100 per call and deducted from the security deposit.


SWIMMING POOL

The swimming pool is unmanned and therefore to be used at your own risk. The pool is fitted with the regulatory safety device as per French Law. Please familiarize yourselves with the instructions of use for the shutter (available at the house), the depth of the pool and how to get out.

You must exercise safety and caution at all times, especially with children and non-swimmers who are your responsibility at all times and should be closely supervised at all times. Drowning is the first cause of death in children aged 6 and under.


We cannot be held responsible for any death or injury in or around the pool.

Diving is not recommended at all. Injuries can occur because of the shallow water. Diving is at your own risks.

The guests shall not interfere with the pool equipment (heater, shutter, cleaning robot). Please carefully follow the instructions for the use of the pool shutter to avoid any expensive damage that will be deducted from your damage deposit.

Professional pool maintenance will be carried out weekly.


POOL HEATING

The swimming pool is not available from end of October to end of April and is only heated during the high season. During this period, the pool heating is included and set at 26 degrees Celsius. The heating can only operates when the filtration is on or about 10 hours per day maximum in the summer.

We cannot be held responsible for a disappointing pool temperature.

The performance of the pool heating system can be affected by weather conditions (cold wind, off-peak season) and outdoor temperature (especially at night).

If your booking rental falls outside the high period July-August and you wish to have the pool heated, please check with owners before booking as this will incur additional pool heating fees.


BARBECUES

Barbecues are only permitted in the outdoor fireplace and naked fires shall not be started anywhere else on the property, as the fire risk in Provence is very high especially in summer.

It is recommended to dispose of all ashes safely and to clean grills thoroughly after use to prevent insects' infestation.


AIR CONDITIONING

The A/C system shall be used reasonably.

Whilst in use, it is very strongly recommended to keep doors and windows closed. Leaving them open completely defies the purpose of the air conditioning system.

If idle time is not allowed to the system, it is most likely to eventually fail you.


INTERNET

Access to Internet is available via Wi-Fi (access code is provided at the property). There may be occasions when internet service might be interrupted (in case of thunderstorms, for instance) and whilst every effort will be made to resume the service, please note that we cannot be held responsible for loss of internet access (or the consequences of loss of access) during your stay.


LOCAL WILDLIFE

Please note that the farmhouse is located in a rural area where wildlife such as animals and insects are as natural part of the landscape as the grass and the trees. It would not be particularly unusual to encounter animals, such as rodents, boars, cats or dogs (stray or belonging to nearby locals), insects such as hornets, wasps, bees, flies, ants, scorpions and spiders, or reptiles. Insects and animals can be attracted to swimming pools, local vegetation or food left out indoor or outdoor.


Therefore, we urge you to

-     keep doors and windows closed as far as practicably possible

-     keep all kitchen surfaces as clean as possible

-     immediately clear all remains of food following cooking or eating.


We cannot be held accountable for the presence of animals or insects at or near the farmhouse. If you suffer allergies triggered by animals, please take precautionary measures before and during your stay.


VEHICLES

If you are intending to take or rent a sports or low slung car on holiday, please consider that the access roads to the farmhouse can sometimes be uneven. They are passable using conventional vehicles, but it is worth considering carefully the model of vehicle you choose to drive.


WEATHER

Many things can be arranged, but sadly the weather is not one of them.

We cannot be held accountable for adverse weather conditions or the consequences of adverse weather.

No refunds will apply in the cases of no sunshine or other adverse weather conditions.


PETS

Pets are not allowed within the property unless prior and separate agreement made at the time of booking.

In any case, pets' owners must make sure that they can provide a letter from their vet confirming that their pet is flea-free, regularly treated against fleas and again prior to their stay at the property. Pets can only be permitted on the ground floor and not in the bedrooms under any circumstance. Pet owners are responsible for making sure to collect after their pet in the garden.

Failure to do adhere to the above rules will lead to the forfeiture of your damage deposit.


SMOKING

Smoking is not permitted within the house but is allowed outside on the terraces, in the garden or around the pool.

Strict precautions must be taken with the safe disposal of cigarettes to prevent risk of fire that can be devastating in this region, especially in the summer.

Smoking inside the villa will result in complete loss of security deposit.


ILLEGAL DRUGS

You agree that you or any member of your party who is found using illegal drugs or allows others to use illegal drugs on the premises will be immediately denied continued occupancy at the property without refund.


LAWFUL USE

You and your party shall not disturb, annoy, endanger, or inconvenience neighbours, nor use the premises for any unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the premises.

Any inappropriate or destructive behaviour could result in the eviction of the entire party without refund.


CHILDREN

You must accept responsibility for the safety of all children of the party at all times, indoors and outdoors.


CARE OF THE PROPERTY

You shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them all in the same place, the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning.


You agree to pay for replacement and/or repairs of all damages that your group has incurred.

We strongly advised that you must refer to the house book available at the property for the instructions of use for the house and all its equipment and appliances.


Any breakage or malfunction of equipment must be promptly reported to the house manager who will organise necessary repair and/or replacement.


This civility will ensure that all our guests can enjoy the farmhouse to the full.
